Businesses use AI images every day in posts, ads and websites. But “can I use this commercially?” does not have one simple answer. It depends on the tool, your plan and what is in the image. Here is a practical overview. This is general information, not legal advice; for anything high-stakes, talk to a lawyer.
1. Read the tool’s terms
Each AI tool sets its own rules on ownership and commercial use, and those rules can depend on whether you are on a free or paid plan. Some tools grant broad commercial rights to paid users; some have conditions for larger companies. Check the current terms for every tool you use and save a copy.
2. Understand copyright uncertainty
In the US, the Copyright Office has taken the position that works generated entirely by AI, without enough human authorship, are not eligible for copyright protection. Human creative contributions, such as selecting, arranging and editing, may be protectable. In practice this means you may be able to use an AI image, but you may not be able to stop others from copying it. Laws and court decisions are still developing.
3. Avoid trademarks and famous characters
Do not generate images that include other companies’ logos, branded products or famous characters. Using them in marketing can create trademark or copyright problems regardless of how the image was made.
4. Be careful with real people
Do not create images that look like real, identifiable people, including celebrities, without permission. Many states protect a person’s right to control commercial use of their likeness. Also never present an AI person as a real customer giving a testimonial.
5. Do not mislead customers
The FTC prohibits deceptive advertising. If an AI image shows a product looking better than it really does, or shows results it cannot deliver, that can be a problem. Use AI for scenes and concepts; show your real product accurately.
6. Consider disclosure
Some platforms label or require labels for AI-generated or AI-edited content, especially realistic images and ads. Follow each platform’s rules, and consider being open with your audience when it matters to them.
